Specific contract for auditing and certification of ATEX quality assurance

Acceptance of the provisions of this contract means acceptance of the conditions contained in the: 

  • rules and regulations for the issuance of ATEX certification (I-O-18) which are applicable to ATEX QAN certification.

  • Rules & Regulations for issuing ATEX quality assurance notification or QAN (I-O-14).

  • rules and regulations for the use of the certificate and certification mark (I-O-16).

  • Relevant Quotation for ATEX certification.

 Article 1- Contract Parties 

This contract has been drawn up by and between the company whose legal identification information has been mentioned in the quotation, hereinafter referred to as The Client, from one side, and Nobel Certification Italia SRLS. (ConformEx), with registration number FE-219093, and fiscal Code 02021200387 with domiciled registered address at floor T-1 , No. 285 , Comacchio St., Ferrara (FE) - Italia, represented by Mr. Peyman Moradi as Managing director, hereinafter referred to ConformEx, from the other side.

Article 2- Contract Subject-matter

2-1- Carrying out an on-site audit for quailty management system of production process/product for the scope which has been specified in relevant quotation and issuing production process/product quality assurance notification (QAN) for the same scope, according to module D (annex IV) / module E (annex VII) of EU directive 2014/34/EU, on the basis of EN ISO/IEC 80079-34:2020 under accreditation of national accreditation body of Italia (ACCREDIA), with 3 years validity, subjected to taking positive decision by ConformEx.

2-2- Performing two annual Surveillance audits and extending the validity of the issued Certificate, referred to clause 2-1 of this contract, prior to annual expiration dates of the issued QAN (12 and 24 months from the issuing date of QAN), so as the performing of aforementioned audits with the probable detected non-conformities, becomes closed, prior to the due dates of annual deadlines (12 and 24 months) of the certificate validity date.

Note 1: The subject matter of this contract is applicable to the application received from the CLIENT, amended if required, finalized, approved by the CLIENT, and reviewed and accepted by ConformEx.

Note 2: Having a valid ISO 9001 certificate, does not remove the responsibility of auditing all the standard clauses of this contract from ConformEx and in this regard, the client shall perform necessary collaboration with ConformEx.

Article 3- Contract Term

This contract term shall be from the date of signing until the date of certificate validity.

Article 4- Total Contract Price

Total contract price shall be paid by the client to ConformEx as per the parts and deadlines, which has been indicated by the relevant Quotation.

Article 5- Jurisdiction 

In the event of a dispute, the court of Ferrara in Italy, is agreed to be competent
